Biztag Service Terms & Conditions
1. Acceptance of Terms
1.1 These Service Terms & Conditions (“Terms”) govern the use of Biztag devices and associated services (“Services”).
1.2 By purchasing, activating, or using a Biztag device, you agree to be bound by these Terms.
1.3 Biztag devices are supplied via authorised distributors (“Distributors”). Payment terms, delivery arrangements, refunds, and other commercial matters are handled solely by the Distributor from whom the device was purchased.
1.4 Biztag is not responsible for payment disputes, pricing decisions, credit arrangements, or refund determinations made by Distributors.
2. Lawful Use
2.1 Biztag is designed to assist with tracking assets and property. Users must only use Biztag for lawful purposes and in accordance with all applicable laws and regulations.
2.2 Biztag must not be used:
(a) for unauthorised surveillance of individuals;
(b) for stalking, harassment, or any unlawful monitoring;
(c) in breach of any applicable law; or
(d) in any manner that infringes privacy, surveillance, or other applicable legislation.
2.3 By using Biztag, you warrant that:
(a) you are legally entitled to track the asset or property to which the device is attached;
(b) you have obtained any permissions or consents required by law; and
(c) your use complies with all applicable laws and regulations.
2.4 Biztag accepts no responsibility or liability for any unlawful, negligent, unauthorised, or improper use of the device. The user assumes full responsibility for ensuring that their use of Biztag is lawful and that they are entitled to track the relevant asset or property.
3. Third-Party Infrastructure & Service Dependency
3.1 Biztag relies on multiple third-party services and infrastructure providers, including cloud platforms, mobile operating systems, and crowdsourced location networks.
3.2 Biztag does not own or control these third-party systems and cannot guarantee:
(a) uptime or availability;
(b) continued access to such services;
(c) uninterrupted operation; or
(d) future compatibility.
3.3 If any third-party provider modifies, restricts, suspends, or permanently removes access to services required for Biztag to function, Biztag shall not be held responsible for resulting loss of functionality.
3.4 In such circumstances:
(a) any ongoing service-related charges (if applicable) will cease;
(b) hardware purchases remain non-refundable; and
(c) Biztag is not liable for loss of use, business interruption, or consequential damages.
4. Location Accuracy & Limitations
4.1 Biztag utilises crowdsourced location data and indirect positioning technologies.
4.2 Location updates depend on external devices and network participation. Biztag does not guarantee:
(a) real-time tracking;
(b) continuous updates;
(c) precise or pinpoint accuracy; or
(d) recovery of lost or stolen assets.
4.3 Biztag must not be relied upon for:
(a) emergency response;
(b) life-safety applications;
(c) mission-critical operations; or
(d) scenarios requiring guaranteed accuracy.
4.4 Location data is provided “as available” and may vary in accuracy, frequency, and reliability.
5. Service Availability
5.1 Biztag will use reasonable efforts to maintain system functionality.
5.2 Scheduled maintenance, emergency maintenance, software updates, or external service interruptions may result in temporary unavailability.
5.3 Biztag does not guarantee uninterrupted or error-free operation.
5.4 No service credits, compensation, or refunds shall be provided for downtime unless required by law.
6. Hardware & Warranty
6.1 Ownership of the Biztag device transfers to the purchaser at the time of sale, unless otherwise agreed in writing.
6.2 Hardware is covered by a twelve (12) month limited warranty against manufacturing defects.
6.3 The warranty does not cover:
(a) water damage (unless expressly rated);
(b) misuse or improper installation;
(c) battery depletion;
(d) modification or tampering;
(e) loss or theft of the device.
6.4 Biztag is not responsible for recovery or replacement of lost or stolen devices.
7. Limitation of Liability
7.1 To the maximum extent permitted by law, Biztag’s total liability arising out of or in connection with the device or Services shall be limited to the original purchase price of the device.
7.2 Biztag shall not be liable for:
(a) indirect or consequential losses;
(b) loss of profits, revenue, goodwill, or business opportunity;
(c) failure to recover an asset;
(d) delays caused by third-party providers.
8. Indemnity
8.1 The user agrees to indemnify and hold harmless Biztag, its directors, officers, employees, and agents from any claims, losses, damages, or legal expenses arising from:
(a) unlawful use of the device;
(b) breach of these Terms;
(c) violation of privacy or surveillance laws;
(d) misuse of tracking data.
9. Data & Privacy
9.1 Biztag collects and processes device data solely for the purpose of providing the Services.
9.2 Data may be processed or stored using third-party cloud infrastructure.
9.3 By using Biztag, you consent to such data processing.
10. Amendments
10.1 Biztag may update these Terms from time to time.
10.2 Continued use of the device or Services constitutes acceptance of the updated Terms.
